This Project aims to analyse the legal and economic challenges raised by the fast-growing tokenisation of assets. Tokenisation is the process of issuing a blockchain-based token that constitutes a digital representation of an existing tradable asset, physical or digital. It is a practice similar to the traditional securitisation, but its reliance on blockchain technology renders it a wholly new operation. Its benefits include higher liquidity, faster settlement, lower transaction costs and improved risk management. However, critical legal uncertainties accompany such advantages. The tokenisation market’s size and its relevant economic impact make it imperative for legal and economic scholars to perform a thorough analysis of all its implications, arguably lacking in the existing literature. An in-depth study is required to build a clear conceptual framework for professional operators, investors, economists, policy-makers, regulators and supervisors, also to reach a mature governance of this phenomenon.
The Reshaping Education for Tomorrow’s European Lawyers (RETEL) Module’s objective is to promote innovation in educating future lawyers in the European Union. The program aims at training future professionals and experts on the existing challenges posed by the rise of technology to the European legal profession. Simultaneously, RETEL promotes the latest developments in European laws concerning the digital economy and promotes a constructive synergy between academia, policy-makers, and citizens.
PARASOL nasce con l’obiettivo di elaborare una metodologia integrata sotto il profilo legale ed informatico di compliance e sostenibilità delle PMI operanti nel mercato digitale, fornendo al contempo una componente educativa.
Il progetto fornirà strumenti legali e informatici alle PMI per adattarsi al mercato digitale in continua evoluzione. La componente educativa promuoverà responsabilità sociale e adozione sostenibile, contribuendo a una trasformazione positiva delle PMI e generando una maggiore fiducia nel mercato digitale.
Il team interdisciplinare di PARASOL, composto da esperti di comunicazione, giuristi, informatici e statistici, offre competenze rare e multidisciplinari nell’ambito delle tecnologie legali. Grazie a uno scambio di conoscenze e prospettive, il team promuove la ricerca applicata e guida la futura ricerca, prendendo in considerazione gli aspetti etici e psicologici delle nuove tecnologie.
PlatformLaw is a training course in Platform & Data Economy European Legal Framework: platform, data- driven business models, AI and contract automation. It is focused on the analysis of EU law in relation to data and information treatment through a holistic integrated approach, which allows students to comprehend the importance of changes in EU norms on citizens, consumer/customers, business operators and society.
The course is coordinated by Silvia Martinelli and it integrates contract law and comparative law (Cristina Poncibò), legal informatics & data protection (Pierluigi Perri), philosophy of law and technology (Massimo Durante), legal tech and start-up clinic learning (Carlo Rossi Chauvenet) to analyse platform from different perspectives.
